By accessing or using SmartChant (“SmartChant,” “we,” “us,” or “our”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the service.

2. Definitions

  • Service: The SmartChant website and related features.
  • Event: A chant or text session created using the Service.
  • Content: Text, information, or materials submitted to the Service.
  • Edit Link: A private URL that allows modification or archiving of an Event.
  • User: Anyone who accesses or uses the Service.

3. Eligibility

You must be at least 13 years old to use SmartChant. If you use SmartChant on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Your content

You retain ownership of your Content.

You grant SmartChant a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your Content solely to operate and improve the Service.

You are solely responsible for your Content and for ensuring it does not violate any law or third-party rights.

5. Acceptable Use

You agree not to:

  • Upload unlawful, infringing, harmful, or abusive Content
  • Harass, threaten, or impersonate others
  • Upload malware or harmful code
  • Scrape, crawl, or access the Service using automated means without permission
  • Interfere with or disrupt the Service
  • Attempt to reverse engineer or bypass safeguards
  • Use the Service for illegal purposes

We may remove Content or restrict access at our discretion if we believe these Terms are violated.

7. Service Availability and Changes

We may modify, suspend, or discontinue the Service or any feature at any time without notice. We do not guarantee uninterrupted or error-free operation.

8. Intellectual Property

The Service, including its design, software, branding, and content provided by SmartChant, is owned by us and protected by intellectual property laws. Except for the limited right to use the Service, no rights are granted to you.

9. Disclaimers

SmartChant is provided “as is” without warranties of any kind. We disclaim all warranties, express or implied, including fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, SmartChant will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of data, events, or profits, arising from or related to your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless SmartChant and its operators from any claims, damages, or expenses arising out of your Content, your use of the Service, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason. Upon termination, your right to use the Service ends immediately. Provisions that should reasonably survive termination will remain in effect.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of SmartChant after changes means you accept the revised Terms.
